TDN: Baffert Gets Injunction to Race in New York

A federal judge at 5 p.m. Wednesday granted trainer Bob Baffert a preliminary injunction in his lawsuit against the New York Racing Association that will allow him to race at Saratoga Race Course, Belmont Park, and Aqueduct Racetrack pending the resolution of the case.

In a civil complaint filed by Baffert June 14, the seven-time GI Kentucky Derby-winning trainer had alleged that NYRA's banishment of him since May 17 over the issue of his repeated equine drug violations violates his Fourteenth Amendment constitutional right to due process

“This suspension is likely to cause multiple irreparable harms,” Judge Carol Bagley Amon of United States District Court (Eastern District of New York) wrote in her 28-page order July 14.

“First is the irreparable harm from the loss of unique competitive opportunities. Part of that harm is monetary….

“Second, Baffert has persuasively argued that NYRA's action will damage his 'reputation and goodwill' in a way that could not readily be remedied should he prevail at trial….

“Finally, to the extent that NYRA contends that Baffert's one-month delay in seeking a preliminary injunction precludes his claim, this argument is unpersuasive,” Amon wrote.

Statement from Dave O’Rourke, NYRA President & CEO

“On May 17, 2021, at a time of crisis for the sport, the New York Racing Association, Inc. (NYRA) took emergency action to temporarily suspend Bob Baffert from racing or training at Belmont Park, Aqueduct Racetrack and Saratoga Race Course. This measure was taken to protect the integrity of thoroughbred racing. NYRA will continue to honor that commitment so that fans, the betting public and racing participants can be confident in a level playing field.

“NYRA is reviewing the court’s decision today to determine our legal options and next steps. What is clear, however, is that Mr. Baffert’s actions and behavior can either elevate or damage the sport. We expect Mr. Baffert to exert appropriate controls over his operation.

"Importantly, the court upheld NYRA’s authority to exclude individuals from its racetracks whose conduct is contrary to the best interests of thoroughbred racing. The court also rejected Baffert’s argument that NYRA had no legal authority to take the action that it did.”

Some has to tell Bob that the only one who can damage his reputation is himself.

I know I'm not a large wagering gambler on horse racing, but I'm not gonna waste money on horse racing anymore as horse racing can't even clean up the industry, even when trying to. So instead of complaining about all the cheaters and the light penalties, I'm just gonna quit betting on horse racing.

If you don't factor this into your handicapping already then you are making a good decision.

If you’re going to stop betting on horses, you might need to change your username.

But seriously, the cheating is very frustrating. If Baffert is able to have all of his suspensions/bans overturned, I think you’ll see more people lose interest in the sport. I’m kind of curious to see how the NYRA case resolves, which I’m guessing won’t be for a while.

I gamble on more than just horse racing so username stays.

If NYRA suspended Baffert to protect the integrity of horse racing, why haven't they tried to suspend Linda Rice for conduct detrimental to the integrity of horse racing? My opinion, the Baffert suspension was nothing more than a PR move.

Absolutely. That’s what I just don’t understand. Why do people complain about the cheating when they KNOW there is cheating and still wager. It’s just the nature of the sport. You have to factor that into how you wager. Back in the days when horses actually ran races and used preps as they were intended, you would learn trainer habits and what were their goals for specific races. You’d know if they had the screws tightened or if this was a race to help tighten them. You’d know if you saw the trainer’s “B” or “C” rider on a horse, they weren’t in it to win but if the main guy was up, especially if he came from out of town, it was top effort time. You knew you’d see trainers instruct riders to stiff a horse to cause a loss or a small margin of victory in order to not be saddled with extra weight the next out. It’s not much different now. Learn the players and what they do and factor that into how you wager.
