Inquiry into a sample irregularity - Jockey O Doleuze


The Stewards today concluded their inquiry into the analyst's report on the urine sample supplied by Jockey O Doleuze, as directed by the Stewards, at the Happy Valley racemeeting on 14 May 2008. Evidence was today taken from Jockey Doleuze and from Dr T S M Wan, the Club's Head of Racing Laboratory. It was decided Mr P Dingwall, Stipendiary Steward, should also appear before the inquiry as a witness and tender evidence. Mr Dingwall was available for cross-examination by Jockey Doleuze. As such, Mr Dingwall did not take part in the deliberations of the Racing Stewards' Panel or their determinations of this matter. A written statement from Mr D K K Leung, Racing Chemist (Operations), who was unavailable to appear at today's inquiry, was submitted into evidence.

Dr Wan reported on 18 May 2008 that the portion of the urine sample supplied by Jockey Doleuze he analysed contained benzylpiperazine which is a prohibited substance (jockey) in accordance with the Rules of Racing of The Hong Kong Jockey Club. Dr Wan also reported the corresponding water control was negative.

On 18 May 2008, the Stewards informed Jockey Doleuze of the analyst's findings and decided it was appropriate for them to exercise the powers they have under Rule 60(3) to stand Jockey Doleuze down from riding with immediate effect until an inquiry into the analyst's findings has been determined. At the same time the Stewards obtained the permission of Jockey Doleuze to have Mr S Chandler, Executive Director, Security & Corporate Legal Services, attend Jockey Doleuze's residence to obtain samples of "Bliss Sensory Pills" and any other item he believed appropriate. Jockey Doleuze had made a written declaration on the sample card corresponding to the urine sample that he had consumed "Bliss Sensory Pills" on 13 May 2008. At the direction of the Stewards, Mr Chandler delivered both an opened and an unopened (sealed) bottle of "Bliss Sensory Pills", together with other items to the Racing Laboratory for analysis.

Yesterday, 20 May 2008, the Stewards received advice from Dr Wan that upon analysis samples of "Bliss Sensory Pills" from each of the submitted bottles were found to contain benzylpiperazine. After having been informed of the analyst's advice Jockey Doleuze said he did not wish to have the reserve portion of his urine sample tested by an independent laboratory.

Jockey Doleuze advised the inquiry he purchased "Bliss Sensory Pills" from a pharmacy while holidaying in Indonesia at the end of March 2008. "Bliss Sensory Pills" is a product manufactured in New Zealand. The product information sheet purported "Bliss Sensory Pills" to be a dietary supplement containing vitamins intended to be used to improve the metabolism for better health. At the Sha Tin racemeeting held 27 April 2008 Jockey Doleuze provided to Mr Dingwall a copy of the product information sheet which was packaged with the "Bliss Sensory Pills" he had purchased. He requested the listed contents of "Bliss Sensory Pills" be checked with the Racing Laboratory to ensure the product did not contain prohibited substances for jockeys.

Mr Dingwall said on 28 April 2008 he forwarded the product information sheet to Mr Leung at the Racing Laboratory to seek his advice on the listed contents of "Bliss Sensory Pills". Mr Leung in his statement said after checking the listed contents he advised Mr Dingwall that none of those contents were prohibited substances for jockeys. Mr Dingwall said after having received this advice he contacted Jockey Doleuze by telephone and passed the same advice to him. Jockey Doleuze said based on this information he formed the view he was permitted to use "Bliss Sensory Pills".

Dr Wan advised the inquiry a further check of the contents of "Bliss Sensory Pills" listed on the product information sheet confirmed none of the listed contents were prohibited substances for jockeys. He said that benzylpiperazine was not included in the listed contents for "Bliss Sensory Pills" despite the samples of the product he analysed clearly having the substance present. He added that having analysed the product, in his opinion, the findings of the presence of benzylpiperazine in the urine sample supplied by Jockey Doleuze is consistent with consumption of "Bliss Sensory Pills". Dr Wan also said to his knowledge benzylpiperazine is not registered as a pharmaceutical in any country and that it is not an illegal substance according to the Laws of The Hong Kong SAR.

On all the evidence before them, the Stewards formed the opinion the presence of benzylpiperazine in the urine sample provided by Jockey Doleuze at the Happy Valley racemeeting on 14 May 2008 arose from the consumption by him of the product "Bliss Sensory Pills". They are satisfied on the available evidence the product information does not show benzylpiperazine as being contained in "Bliss Sensory Pills" despite the substance being clearly present in the samples of the product analysed by Dr Wan.

Jockey Doleuze had followed the Club's advice previously given to all jockeys in Hong Kong to have the listed contents of any supplement they are considering consuming checked for the presence of prohibited substances. The Club's advice to Jockey Doleuze on the listed contents of "Bliss Sensory Pills" was correct.

The Rules of Racing of The Hong Kong Jockey Club place the responsibility on a jockey to be free of prohibited substances when he is present on a racecourse at which he has an engagement to ride in a race. However, under the Rules the finding of a prohibited substance in a sample provided by a jockey does not necessarily oblige the Stewards to penalise the jockey concerned. Having given careful consideration to all the circumstances of this matter, the Stewards chose to exercise their discretion in this case.

Jockey Doleuze, who is currently suspended from riding in races for a careless riding charge, was advised by the Stewards he continues to be stood down, at their direction, from riding in track work and trials until such time as he provides a urine sample which upon analysis is reported to be negative. Jockey Doleuze informed the inquiry he last consumed "Bliss Sensory Pills" on Friday 16 May 2008.

The Stewards will discuss with all jockeys in the immediate future the responsibilities the Rules of Racing place on jockeys and the possible implications of the consumption of supplements by them. The aim of this discussion will be to clarify any misunderstandings which exist with current practices.

HKJC...

The Stewards this morning spoke with Mr J Moore, the trainer of VIVA PATACA. Mr Moore had unsuccessfully endeavoured to contact the Stewards yesterday. Mr Moore said VIVA PATACA had sustained an injury to its right front foot during track work yesterday as a result of an incident involving another horse. Mr Moore advised the Stewards he had worked VIVA PATACA this morning in accordance with the horse's scheduled programme and in his opinion it was suitable to start in the Citi Champions & Chater Cup to be run at Sha Tin this Sunday 25 May 2008.

At the direction of the Stewards, Dr K H Lam, Veterinary Officer, this afternoon examined VIVA PATACA at the stables of Mr Moore. Dr Lam said the horse in his opinion at this time is suitable to fulfil its engagement in the Citi Champions & Chater Cup. VIVA PATACA will continue to be monitored in the lead up to Sunday's race.

The success of Hong Kong superstar Good Ba Ba will have an impact that goes way beyond the horse’s racing lifetime, with owner John Yuen Se-kit announcing this week the creation of the Good Ba Ba Foundation.

Yuen said that 70% of all prize money won by Good Ba Ba would go to the foundation, which will be invested with a view to supporting special charities and projects on a long-term basis.

Yuen said he has already given HK$1.6 million to accredited agencies working for the victims of the Sichuan earthquake disaster in China, and HK$1.3 million to support the Equestrian Games of the Beijing Olympics, all in the name of Good Ba Ba.

Good Ba Ba, whose Cantonese name Ho Ba Ba means “good father”, has been touched by the way the public has adopted the racehorse who was deliberately named as a statement about the importance that good fathers represent to families and the greater community.

"The people of Hong Kong have really embraced Good Ba Ba as their horse, they have given him great support,” Yuen said. “This foundation gives my family the chance to return that support, and to allow the achievements of Good Ba Ba to flow back to the people of Hong Kong, and China, for many years to come.”

Good Ba Ba has rewritten the record books this season, becoming the first horse to make a cleansweep of the Hong Kong Jockey Club’s four major mile races, and throwing in a defeat of Sacred Kingdom in the group I Queen’s Silver Jubilee Cup for good measure.

The gelding continues to be a running advertisement for the Hong Kong International Sale, where he was purchased originally by trainer Alex Wong Yu-on, who took him to the title of champion griffin in his first season and right through to Class One as a 4-year-old.

Since being transferred to Andreas Schutz 18 months ago, Good Ba Ba has become a revelation, winning eight of his next 11 starts including two international group Is this season --- the Cathay Pacific Hong Kong Mile and the Champions Mile.

As the winner of four group I races this term, as well as being the conqueror of Sacred Kingdom (albeit controversially), he is an odds-on favorite to be Horse of the Year.

Good Ba Ba has already won HK$32,466,500 in prize money but at his next start, in the Group One Yasuda Kinen (1,600m) in Tokyo, he will compete for one of the richest prizes in world horse racing --- slightly over HK$15 million.

First prize in the Yasuda is Yen 100 million (HK$7.42) and, as the winner of the Champions Mile, he is also eligible for an Asian Mile Challenge bonus of US$1 million (HK$7.8 million). The double is certainly achievable, having been won by Bullish Luck just two years ago.

Yuen has not been keen to travel Good Ba Ba away from Hong Kong before, and earlier in the year turned his back on the US$5 million Dubai Duty Free to stay at home. But the creation of the Good Ba Ba Foundation and the big prize available in Japan has changed the businessman’s perspective. Good Ba Ba is now racing for a lot more than the pleasure of John Yuen.

Good Ba Ba is already in Japan, and trainer Schutz said last night the gelding arrived “fit and well” after traveling safely and uneventfully.

The season is winding down (crying face here).

Good luck to the cellar dwellers and slightly disappointing types.....Sinospiel in R1 (he was 3rd once. 29 starts), Lady First (the only girl in HK as far as i know anyway - winless in 9 starts) in R2, Wait for Me (R2) who lives up to his name a lot (gotta love it), and Puerto Rico in R5 (I think he hates it there or something... hasn't shown any thing. Too bad...).

Racing Incident Report
ROYAL PRINCE, which was fractious in its stall, began awkwardly and stumbled. Shortly after the start, SURVEY SURVEY lost its position when awkwardly placed between AMBITIOUS GENERAL and MY CHOICE. Making the turn at the 800 Metres, SURVEY SURVEY was steadied when awkwardly placed inside SUNNY KING which got its head on the side and shifted in away from POCKET MONEY. Near the 600 Metres, SURVEY SURVEY was checked away from the heels of SUNNY KING which was checked away from the heels of AMBITIOUS GENERAL. When questioned Mr J Moore, trainer of JOYFUL WINNER, said he had a discussion with the owner of the horse who expressed disappointment that when being ridden in a rearward position as is usual in recent races JOYFUL WINNER whilst closing off strongly had failed to win. He said it was therefore decided that with JOYFUL WINNER returning to handicap conditions in today race and carrying a large weight, the horse should be ridden further forward than is usual in a midfield position. He said JOYFUL WINNER began well and was ridden along for a short distance in an endeavour to carry out the riding instructions, however, travelled in front of midfield because of the manner in which the race was run. He said JOYFUL WINNER travelled a little keenly in the race and as a consequence failed to finish off as hoped. Mr Moore was also questioned regarding ABLE ONE. He said he confirmed when the horse last raced it was anticipated the race would be run at a strong tempo and because of this the instructions were to ride the horse in about a midfield position. He said that race was run at a much slower than anticipated tempo and consequently ABLE ONE travelled slightly further back than he had hoped, proved difficult to settle, in the Straight hung in as it has done previously and was disappointing. He said today he consulted Z Purton, the rider of ABLE ONE, as to how he thought the horse would be best ridden. He said it was decided from a more favourable draw ABLE ONE would be best suited ridden in a forward position possibly behind the lead. He said ABLE ONE began well and when DOWN TOWN did not cross, he was able to maintain the rail in the lead. He said the middle sections of the race were run at a tempo to suit ABLE ONE and as a consequence of this and also that the horse was racing on the rail, it was able to kick strongly in the Home Straight. He said of the stable four runners in the race ABLE ONE was not considered to be in the top two chances and he was somewhat surprised by today performance. Mr Moore was advised his explanations would be reported. When questioned regarding the performance of POCKET MONEY, F Coetzee said he was satisfied with the position his mount obtained in the run from the outside barrier. He said however POCKET MONEY which was racing first up today from a lengthy spell travelled more keenly than is usual and as a consequence failed to finish the race off. He added whilst POCKET MONEY has shown some wet track form in the past the horse did not appear to handle the conditions of today track. O Doleuze (EGYPTIAN RA) said he was instructed to lead on the horse, however, if other runners were intent on leading, he should ride the horse where it was comfortable. He said EGYPTIAN RA began awkwardly and bumped the inside gate of its stall. He said after this he allowed EGYPTIAN RA to travel forward, however, did not ride along vigorously given that the horse has a history of over-racing. He said after the 1000 Metres he believed he would have been required to make use of EGYPTIAN RA to cross to the lead and therefore he steadied his mount to travel in a three wide position without cover just off the pace. He said he commenced to ride EGYPTIAN RA along making the Home Turn, the horse immediately commenced to hang in and gave ground. He said EGYPTIAN RA raced lat?today. EGYPTIAN RA was sent for an official veterinary inspection. A veterinary inspection of EGYPTIAN RA after the race did not show any significant findings. POCKET MONEY, ABLE ONE and MY CHOICE were sent for sampling. After the race, it was reported BULLISH CASH had lost its left front plate.

Good luck to 8YO First Knight in R4. HIs 104th start and first time with Brett up. Gotta hope he gets that 9th win.
