That is considered sovereign soil, and the Chinese knew he did it but could not prove it. At the end of last season, the show closed with him getting captured by the Chinese.

2.) The President when he left was President Logan, who was a smarmy jerkface who was more or less "in" on what was happening. He "tried" to do something good for America and it backfired, then he broke all sorts of laws trying to cover it up. Jack caught him and got him to unknowningly confess at the end of last season. This season's president Wayne Palmer's brother David Palmer was the original president on 24. He was killed in the first seven minutes of last season (though he was not the president at the time), and he was played by Dennis Haysbert.

3.) Yes, the show has always been about terrorists, and foiling their huge plans for American destruction.
