it's funny when i see people say 'why should they get geneva rights'. i don't think some realize what the rules under the geneva conventions entail. it certainly doesn't offer the right to remain silent-all it does is hopefully keep things like andersonville from happening, or the bataan death march. on the other hand, geneva has rules about dealing with soldiers in a military court; it doens't give them u.s. constitutional rights- i doubt you read miranda to every soldier who is captured!
also, under geneva, enemy combatants can be held til the end of the war. no trial, no jury; they just sit and wait for the end of the fighting. this guy could have been put under lock and key and kept there without any more press, no trial, no lawyers, no headlines-in other words, no attention like he will garner now. and what if, god forbid, he was to be set free under a technicality?! lol yippee, deported to try again.
