Bob Fitrakis, in his capacity as the Chair of the Ohio Green Party, filed suit at approximately 12:30pm on Monday, November 5 against Ohio Secretary of State John Husted and Elections Systems and Solutions for their clandestine installation of uncertified and untested software.

Judge Frost, U.S. District Court Southern District Court of Ohio, agreed to the hearing to be held Tuesday, November 6.

The suit seeks immediate the injunctive relief of removing the untested, uncertified software from all county tabulators.

Should there be insufficient time or resources to remove said software from the tabulators, those tabulators will not be used and all ballots will be counted by hand if either the state or federal judge grants the injunction.

I read this story this afternoon. These sumbitches will pull anything! I am praying for a clean vote tomorrow but nothing would surprise me with the Right-Wing SCUM out there! :mad:

I'm trying to find what the Federal Judge ruled on that patch from the 9am hearing.

Husted as another hearing tomorrow in front of a Federal Judge, for his refusing to count some absentee ballots.

I predict: we may not get Ohio or Florida voting results today due to massive confusion, wrong counts, long lines, disaster, etc.

BUT I predict that Obama will be declared winner without those states, as he'll get Virginia, Colorado, Nevada, New Hampshire, Pennsylvania, Michigan, and yes, even North Carolina!

Fitrakis returns from federal court hearing on Ohio voting machine software patch

Bob Fitrakis just returned from court for his lawsuit to stop the software patches on voting machines in Ohio. Judge Frost has not ruled on the matter yet, and at the conclusion of the hearing at approximate 10:20am he said he would issue a ruling “forthwith,”(before noon today).

The new unapproved software stays
 
COLUMBUS, Ohio (AP) — A judge has rejected claims raised in an election-eve lawsuit that new software used in voting equipment in some Ohio counties could cause ballots to be altered.

Federal judge Gregory Frost said in a ruling Tuesday that the elections activist who raised the allegation has shown zero chances of succeeding if the case went to trial.

Frost said Bob Fitrakis, a Green Party candidate for Congress, presented only theories and opinions that the software might cause voting night irregularities.

Fitrakis and his attorney had wanted Frost to order Ohio Secretary of State Jon Husted (HYOO'-sted) to stop using the software and break the state's contract with Omaha, Neb.-based Elections Systems & Software.

A message was left with Fitrakis' attorney seeking comment.
