Oral argument before the appellate court in Albany was held today. A decision on his challenge to the NYSRWB's suspension should come down in 4-8 weeks, if the usual time parameters hold in this case.

Dutrow is probably the closest thing New York has seen to a Jeff Mullins over the last 15 years.
Dutrow debuted only 25 horses last year -- and 18 so far this year -- a lot of them debuted in maiden claiming races. While I have been on record as believing that Dutrow's cavilier attitude towards the rules and authorities in general make the actions taken against him justifiable to a degree, I think the vindictivness of many in the game towards him and the glee that accompanied this news by many in the media says a lot more about where we are headed than any farcical Congressional hearings may. The thing to remember is that Dutrow's case is unique simply because of the volume and regularity of his violations and there isnt going to be any trend towards more sentences like this because guys have gotten a lot more careful and cleaned up how they do business. They will appeal to a higher court,string it out for another couple of years,then admit his horses were eating poppyseed bagels and just like his cheating mentor Bobby Frankel will probably get the fastest horse in the world named after him

If I recall correctly, the two exceptions when a right to appeal to the Court of Appeals exists is when two judges at the appellate level dissent (not the case here), or where a federal Consitutional question is involved, as the highest state court is the next stop on the way to US Supreme Court. Needless to say, if that is the case, then the appeal process could become far longer. I have thought for some time that Dutrow's attorney knew it was likely that he was going to lose, but by invoking the Due Process argument involving Sabini, he may have found a creative way to drag this out another 18-24 months. |
