According to the DRF article:

For purposes of comparison, motor vehicle operators in Ontario face a charge of impaired driving if they blow over .08 milligrams of alcohol per 100 millilitres of blood. A reading between .05 and .08 results in a roadside license suspension of three to seven days.

Hopefully he recognizes it for what it really is. He needs to face his problem again and get back on track. For purposes of the game you just don't know what his impairments are on any given day for handicapping.

Hopefully he gets some help before he has a catastrophe on the track for him and/or anyone in a race with him, let alone a car with his kids in it.

every track does breathalizers either daily or on random checks. I remember hanging out in the river downs jock room before the races, and they have an outside agent who administers the test to ever jock who enters the room, every day, right when they walk in.

it's a standard practice
