Proposition 8 on Charlie Rose
 
For those of you that like the interviews
Charlie Rose does on PBS, like the head of the FBI last
night (I really liked it), Rose will be speaking for 30 minutes with David
Boies tonight on Prop 8 in California.

I know a lot of you "guys" have an interest
in this. It should be good.

On tonight, PBS, Charlie Rose.

An interesting twist to the current legal status of California’s Proposition 8, which prohibits same-sex marriage. On July 2, before Bay Area Chief U.S. District Judge Vaughan Walker (a Bush I appointee) legal stars Ted Olson and David Boies will challenge Prop 8 in federal court, arguing that the marriage ban violates federal constitutional rights of equal protection and due process. The legal odd couple of Olson and Boies — they were on opposite sides of the historic Bush v. Gore 2000 case — will ask for an injunction against enforcement of Prop 8 and a resumption of same-sex marriage rights in California.

Given that the famously liberal Ninth Circuit Court of Appeals is a venue the lawsuit will likely eventually face, there’s a solid chance the Olson/Boies effort will encounter success before it hits the Supreme Court. Also, since same-sex marriage advocates have adopted the argument that denial of gay marriage is a denial of civil rights and hence, the Constitution, one would think they would eagerly sign on to the federal case, which is on behalf of two same-sex couples.

But that’s not happening. In fact, gay marriage advocates are running away from this case. A coalition of same-sex marriage advocates, including the ACLU, want nothing to do with it. They are urging instead to focus on a new vote on Prop 8.



The legal tactics taken are interesting.
Hopefully they will be explained in a clear manner
tonight.

IMO marriage is a bad idea gay, straight or otherwise. That's why there are so many furnished garages and or basements w/big screen TV's out there.

doesn't mean certain people should be banned from choosing that path
