AEG wins court order to stop VLT selection process

SARATOGA SPRINGS – The firm chosen to run Aqueduct Race Track’s racino earlier this year, and later disqualified, has won a court order bringing the latest selection process to a halt. Justice Barry D. Kramer issued a temporary restraining order on Monday, stopping the state Lottery Division from conducting its review of one remaining bidder – Genting New York LLC – until a July 23 hearing is held. Papers were expected to be served today, but spokesperson Jennifer Givner said Lottery hadn’t received them by early afternoon. The suit was filed by Aqueduct Entertainment Group in state Supreme Court, Schenectady County, where Lottery is headquartered. |

From a legal standpoint, I wouldn't read too much into this - yet.
If I had to make an educated guess about the procedural mechanisms behind the issuance of the temporary restraining order (TRO), it was probably secured because the Lottery isn't scheduled to make a recommendation until August 3 and because the court scheduled a quick turnaround date for a hearing on AEG's application for a preliminary injunction (on July 23). The TRO just maintains the status quo until the court rules on the preliminary injunction application. In order to prevail on that application, AEG has to show a likelihood of success on the merits. Based on a cursory reading of the complaint, I don't think this lawsuit has much merit, and if that's the case, then the application for a preliminary injunction would likely be denied on July 23 and the TRO lifted. If the court reserves on a decision on July 23 and TRO is still in effect on August 3, that's a whole different ball game (and a long litigation process could ensue). |

Aqueduct Situation Gets Even Messier, If Possible
SL Green, which was recently eliminated from consideration after Lottery said it did not follow all the bid requirements, today sent a formal letter of protest to the Lottery challenging the way the current proposal process has been implemented. |
This is like a bad divorce, where both parties fight so much that there's nothing left to divide -- only in reverse.
The opposite is that all parties are fighting so much prior to getting this off the ground that any potential profits are going to seem like less due to all the time that has elapsed and legal expenses added to the potential startup costs. |
